We reserve the right to modify them at any time without prior notice. You acknowledge and agree that it is your responsibility to regularly review this app and these Terms and Conditions for any changes. Continued use of the app following any updates signifies your acceptance of the revised Terms and Conditions and your agreement to comply with them. The website www.fitvisio.com and the "FitVisio" app are owned by "Macdom s.r.o.", a company registered at Rybná 716/24, Staré Město, 110 00 Praha, Czech Republic.

1. Who can use the Services

1.1 You must be at least 13 years old to use the Services.

1.2 If you are under 18 years old, it is required that your parents or adult caregiver is aware of your registration and usage of the Services. Additionally, any payments for the service or application require consent from parents or adult caregiver.

1.3 If we discover that someone is under the minimum age required to have an account on FitVisio, we will deactivate their account. If you believe your account was banned by mistake, you have the option to appeal the decision.

1.4 Please note we are are not responsible for any bypasses of these conditions.

2. Intellectual Property

2.1 By agreeing to these Terms and Conditions, you recognize and accept that all content available on this Application is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws, and belongs exclusively to FitVisio.

2.2 You may only use the content as explicitly permitted by us or the relevant content provider. With the exception of one copy made for personal use, you are not allowed to copy, reproduce, modify, republish, upload, post, transmit, or distribute any materials or information from this Application in any form or by any means without prior written consent from us or the content provider. You are responsible for securing permission before reusing any copyrighted material found on this Application.

You agree to defend, indemnify, and hold us harmless from any claims, losses, liabilities, costs, and expenses (including, but not limited to, attorney's fees) resulting from your infringement of any third-party rights. You acknowledge that your license to use the Application is limited, non-exclusive, and non-transferable. Given that the Application may contain errors or bugs, you agree to use it with caution and to avoid any actions that could lead to the loss of your property or information, or that of any third party.

FitVisio is not a medical provider and does not offer medical services or advice. Nothing on this website, within the Services or in the Application should be considered medical advice or diagnosis. The information accessible via the Services should not be used as a basis for medical decisions or to diagnose or treat any health condition or illness. YOUR USE OF THE SERVICES DOES NOT ESTABLISH A DOCTOR-PATIENT RELATIONSHIP WITH FITVISIO.

5.2 Before starting any diet plans, exercise routines, or other fitness or wellness activities referenced or provided through the Services, you should consult with a physician or healthcare professional regarding any health-related questions. If you are undergoing treatment for a medical condition, taking prescribed medication, or following a therapeutic diet to manage a disease, it is important to speak with your doctor before using the Services. Each time you use the Services, you confirm that you are not using them to seek medical treatment. 6. Term and Termination

6.1 These Terms and Conditions will take effect when you create a FitVisio account or begin using FitVisio and will remain in force until either you or we terminate them.

6.2 FitVisio reserves the right to terminate this Terms and Conditions or suspend your account at any time in case of unauthorized, or suspected unauthorized use of the Application whether in contravention of this Terms and Conditions or otherwise. If FitVisio terminates this Terms and Conditions, or suspends your account for any of the reasons set out in this section, FitVisio shall have no liability or responsibility to you.

6.3 Accounts inactive for more than one year will be deleted, and data cannot be restored. You will receive an email notification approximately one month before the account is scheduled for deletion.

6.4 If an account is removed, deleted, or banned by you or by FitVisio, no refunds will be issued for any payments made for the service.

7. Security

7.1 If you suspect that your account has been hacked or compromised, please inform us immediately.

7.2 We take the security of our users seriously. Although we make every effort to safeguard your Personal Data, User-Generated Content, and account, we cannot guarantee that unauthorized parties won’t bypass our security measures. If you become aware of or suspect any breach or unauthorized access to your account, contact our Support Team right away.

8. Assignment

8.1 FitVisio may assign this Terms and Conditions or any part of it without restrictions. You may not assign this Terms and Conditions or any part of it to any third party.

9. Governing Law

9.1 These Terms and Conditions, along with any disputes or claims arising from them, will be governed by and interpreted in accordance with the internal laws of the Czech Republic, without regard to any choice or conflict of law principles.

9.2 Any legal action or proceeding related to these Terms and Conditions or the Application must be filed exclusively in the federal courts of the Czech Republic.
